Terms and Conditions of Sale and Use

1. General information

The website www.maylineconfection.com (the "Site"), along with the services and all product offers or sales made through it (including any associated mobile application), is operated by Mayline Confection ("we," "our," "us").

These Terms and Conditions of Sale and Use (the "Terms") set out the conditions under which visitors or users ("you," "your") may access the Site, use our Services, and purchase our Products.

By accessing our Site or using our Services, you acknowledge that you have read these Terms, accept them without reservation, and agree to comply with them. If you do not accept these Terms, you must immediately stop using the Site and/or the Services.

2. Legal capacity

You declare that you are of legal age (18 or older) and have the legal capacity to enter into a binding contract.
If you are a minor, you may only use our Services with the authorization and under the responsibility of your parents or legal guardians.

3. Products

The descriptions, photos, illustrations, and characteristics of the Products are provided on the Site for informational purposes.

Although we take care to ensure the accuracy of the information, errors or variations may occur. These elements do not constitute a contractual commitment on our part.

You must carefully review the notices, instructions for use, and labels before using any of our Products. We cannot be held responsible for damage resulting from improper use.

Order options and applicable fees

Our Products are offered through three order options: Ready to order, Customizable, and Ready to print.

The Customizable option includes a customization fee of $25 (one time fee per order), covering the graphic design work and the proof provided for your approval. The Ready to print option, in which you provide us with your own print ready file, includes a technical handling fee of $25 (one time fee per order), covering the review and preparation of your file before printing.

A minimum order of 20 units applies to all options, except for the sets of 4 cards in the Holidays collection. 

4. Orders and formation of the contract

Any order placed through the Site implies acceptance of these Terms.

By clicking the "Buy" button, you make a firm and definitive purchase offer.

You will receive an order acknowledgement email, which does not constitute acceptance.

The contract is deemed concluded only when we send you an acceptance email or proceed with delivery of the Products.

We reserve the right to refuse any order for legitimate reasons (suspected fraud, incorrect address, out of stock, etc.).

Displayed prices include applicable taxes, unless otherwise stated. Shipping fees may apply (see the Delivery section).

We reserve the right to change our prices at any time, but Products will be billed based on the rates in effect at the time of your order.

5. Delivery

Delivery available within Canada only.

Delivery times: 1 to 6 business days on average, not guaranteed.

Additional fees may apply for remote areas. In such cases, we will contact you before shipping.

If the address provided is incorrect, return and reshipping fees will be at your expense.

Mayline Confection cannot be held responsible for delays attributable to carriers, weather conditions, periods of high demand, or events of force majeure.

6. Promotional offers

We may occasionally offer coupons, gift cards, or discounts.

These Offers are valid only for the period indicated and according to the conditions specified.

They may not be transferred, reproduced, exchanged, or resold without our written consent.

7. Return and refund policy

Due to the nature of our Products, no returns or refunds are accepted. All orders are firm and final, except in cases of a proven defect attributable to Mayline Confection.

Our Products contain seeds, a natural and perishable element whose germination capacity deteriorates when exposed to light, heat, or humidity. For this reason, seed paper cards and seed packets alike cannot be returned or exchanged once delivered.

In addition, Products ordered through the Customizable or Ready to print options are made to order based on your information. As they are produced specifically for you, they cannot be returned, exchanged, or refunded.

8. Proof approval

For any order placed through the Customizable option, a digital proof is sent to you by email before printing. It is your responsibility to carefully check every element: spelling, names, dates, wording, and layout.

Printing begins only after your written approval of this proof. Once the proof is approved, you assume full responsibility for its content. No reprint or refund can be claimed for an error present in a proof you have approved.

For the Ready to print option, you provide us with your own print ready file. You are responsible for its accuracy and compliance: spelling, wording, layout, resolution, dimensions, and colours. We print the file exactly as you provided it, once approved, and make no changes to the content.

9. Files provided by the customer ("Ready to print")

Under the Ready to print option, you provide us with your own file so that we can print it on our seed paper. By providing this file, you declare that you hold all necessary rights to its content (text, images, logos, graphic elements) and you indemnify us against any third party claim relating to intellectual property.

We print your file exactly as provided. It is your responsibility to verify its accuracy and technical quality before sending it to us. We do not modify the content and cannot be held responsible for any error, mistake, or defect present in the file you have approved.

The final result also depends on the quality of the file provided (resolution, colour mode, dimensions). Given the handcrafted nature of our seed paper, slight variations in colour, texture, and cutting are normal and do not constitute a defect.

10. Indemnification

You agree to indemnify and hold us harmless from any claim, damage, loss, or expense (including legal fees) arising from your use of the Site or your purchases in violation of these Terms.

11. Limitation of liability

To the fullest extent permitted by law, our liability is limited to direct and foreseeable damages, and notably excludes indirect losses (loss of revenue, data, customers, opportunity, etc.).

We cannot be held responsible for any failure or delay caused by an event of force majeure or beyond our control (strike, bad weather, carrier failure, etc.).

12. Changes to the Terms and Services

We reserve the right to modify these Terms at any time. Changes take effect as soon as they are published on the Site.

Continued use of the Site after changes constitutes acceptance of the new Terms.

We may also suspend or discontinue all or part of the Services, without notice or compensation.

13. Translation

This Site is offered in French and English. In the event of a discrepancy in interpretation between the two versions, only the French version shall prevail.

14. Governing law and dispute resolution

These Terms are governed by the laws of Quebec.

In the event of a dispute, an amicable solution will be sought first.

If no agreement is reached, you may resort to consumer mediation.
